Thank you for visiting this website, offered by Springdale Nazarene Church, Inc. and our affiliated legal entities ("Springdale Nazarene Church," "SNC," "SNCLife," "we," "us," or "our"). These Terms of Use (the "Terms") govern your access to and use of our websites, including snclife.org and springdalenaz.ccbchurch.com (collectively, our "Websites"), as well as the services and tools related to the Websites (including but not limited to any mobile and software applications downloaded from these Websites or obtained elsewhere) (collectively, the "Services").
The Websites and Services are available ONLY TO USERS 13 YEARS OF AGE OR OLDER. Please read these Terms carefully. If you have any questions, please contact our Web Support Team. By accessing or using our Websites or Services, you agree to these Terms, which include our Privacy Policy incorporated herein by reference.
NOTICE REGARDING DISPUTE RESOLUTION: In accordance with 1 Corinthians 6:1-8, all disputes or claims arising under this Privacy Policy, or relating in any way to your use of the Websites or Services, will be resolved first by mediation. If mediation is unsuccessful, disputes will be settled through final and binding arbitration as provided in Section 9 of our Terms of Use. Unless you opt out, you agree to pursue claims against Springdale Nazarene Church solely on an individual basis and not as part of any class or representative action.

To access the Websites or Services, or some of the resources they offer, you may be required to create an SNC Commons Account and provide certain registration details or other information. You agree to: (i) provide accurate, current, and complete information about yourself as requested in any registration form (the “Registration Data”) and (ii) maintain and promptly update the Registration Data to ensure its accuracy and completeness. Springdale Nazarene Church will use the email address provided in your Registration Data for notices, statements, and other communications, so you must keep it current.
If you create or receive a username, password, or other security credentials, you must treat this information as confidential and not share it with any other person or entity. Your SNC Commons Account is personal and must not be used to grant others access to the Websites or Services. To safeguard security, you must notify us immediately of any unauthorized use of your credentials or any other breach of security. Exercise caution when accessing your account from public or shared computers to prevent unauthorized access to your information. We reserve the right to disable any username, password, or other identifier at our discretion if we believe you have violated these Terms of Use.

The Websites or Services may include links to third-party websites (“Linked Sites”). We do not control or endorse these Linked Sites and are not responsible for their content, stability, or transmissions. SNC provides these links for convenience only and does not guarantee the accuracy of any content found on Linked Sites. 5. Intellectual Property Rights; Content; Copyright Infringement Notification Process
5.1 Intellectual Property Rights
The materials, services, and content on the Websites and Services, including their selection and arrangement, are protected by intellectual property laws. Unauthorized use of the Websites or Services may violate these laws and these Terms of Use. Springdale Nazarene Church and its licensors retain all rights, titles, and interests in the intellectual property associated with the Websites and Services. These Terms of Use do not transfer any ownership rights to you. The trademarks, logos, and service marks displayed, including but not limited to “SNCLife,” are property of Springdale Nazarene Church or third parties. You may not use these marks without prior written consent. Copyright notices and proprietary information must not be removed or obscured.
5.2 Your Content
The Websites and Services may allow you to post data, text, pictures, videos, recordings, or other materials. Publicly shared content (“Public Content”) is accessible to all visitors, while restricted content (“Private Content”) is only visible to designated users. Collectively, these are referred to as “Your Content.” You retain ownership of Your Content but grant Springdale Nazarene Church a nonexclusive, worldwide, royalty-free, irrevocable, perpetual license to use, reproduce, distribute, adapt, display, and promote Your Content, including for marketing purposes. While we will strive to contact you regarding marketing usage, we reserve the right to remove any content at our discretion without notice if deemed inappropriate.

SPRINGDALE NAZARENE CHURCH PARTIES DO NOT WARRANT THAT THE WEBSITES OR SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, THAT THE SERVICES OR SERVERS THAT MAKE THE WEBSITES AND SERVICES AVAILABLE WILL BE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ANY CONTENT PROVIDED IS ACCURATE, RELIABLE, CURRENT, OR COMPLETE.

YOU UNDERSTAND AND AGREE THAT SPRINGDALE NAZARENE CHURCH PARTIES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES (EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM YOUR USE OR INABILITY TO USE THE WEBSITES OR SERVICES. IN NO EVENT SHALL THE TOTAL LIABILITY OF SPRINGDALE NAZARENE CHURCH TO YOU EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THE WEBSITES OR SERVICES.
7. Indemnification
You agree to indemnify, defend, and hold harmless Springdale Nazarene Church Parties from all claims, losses, expenses, damages, and costs, including reasonable attorneys’ fees, arising from your violation of these Terms of Use or any actions connected with your use of the websites or services. This includes claims arising from your content, actions of your agents, or any other entity gaining access through your credentials.
8. Injunctive Relief
Your breach of these Terms of Use may result in immediate and irreparable harm to Springdale Nazarene Church. Therefore, we are entitled to equitable relief to compel you to cease unauthorized use, evaluation, or disclosure of information obtained through our websites or services, in addition to any other legal remedies.
9. Arbitration Agreement and Waiver of Class Action
Except as outlined below, ANY DISPUTE OR CLAIM ARISING UNDER THESE TERMS OF USE, INCLUDING THE PRIVACY POLICY, OR RELATING TO YOUR USE OF THE WEBSITES OR SERVICES, WILL BE RESOLVED BY FINAL AND BINDING ARBITRATION RATHER THAN IN COURT.
Exceptions include:
a) Small claims that qualify for a court of limited jurisdiction; and
b) Claims for injunctive relief related to intellectual property infringement or misuse.
Any dispute will first attempt to be resolved by mediation. If mediation fails, arbitration will be conducted per the Rules of Procedure for Christian Conciliation, Institute for Christian Conciliation (available at www.peacemaker.net or by calling 406-256-1583). The arbitrator has authority to rule on jurisdiction or enforceability issues. However, THE ARBITRATOR MAY NOT HEAR CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTIONS, NOR AWARD PUNITIVE DAMAGES OR ATTORNEYS’ FEES. If the Institute for Christian Conciliation ceases to exist, arbitration will follow the Rules of the American Arbitration Association.
You may opt out of this arbitration agreement by notifying Springdale Nazarene Church in writing within 60 days of first use of the websites or services. By using the websites or services, you agree that the Federal Arbitration Act, applicable federal law, and the laws of the state of Ohio (without regard to conflict-of-law principles) will govern these Terms of Use and related disputes.
10. No Waiver; Severability
Failure to enforce any provision of these Terms of Use does not constitute a waiver. If any provision is deemed unenforceable, the remaining provisions remain in effect.
11. Assignability
Springdale Nazarene Church may assign its rights and delegate its duties under these Terms of Use without notice. You may not transfer your rights or obligations under these Terms without prior written consent.
11. Relationship
These Terms of Use do not establish a partnership, joint venture, employment, franchise, or agency relationship between you and Springdale Nazarene Church.
